Community Crowdfunding collects non-personally identifiable information from you regarding your usage of our Site (such information, “Non-Personally Identifiable Information”). Non-Personally Identifiable Information may include, without limitation, website pages viewed, articles, presentation and videos viewed, time spent using certain features of the Site, demographic data such as server locations, cookies existing on your computer, search criteria used and results, date, time, connection speed, and other information which does not specifically identify you. Community Crowdfunding also collects information from you when you sign up for an Account (as defined in our Terms of Use), make an investment, verify your identity, residency or qualification as an “Accredited Investor” (as defined in our Terms of Use), provide payment instructions or send us an email or other communication through the Site which may enable us to identify you personally, such as your email address, name, phone number, birthday, age, Social Security number and/or taxpayer identification number, investment objectives, investment experience, assets and income, information from your transactions with us, such as your Account balance and Account usage, information obtained from others, such as the Internal Revenue Service (IRS) and credit reporting agencies, physical address such as home or business address, or internet protocol (‘IP’) address, which may also be contained on server logs, or other information you provide or upload to the Site such as photographs, answers to questionnaires or surveys, or responses filled in on blank forms made available on the Site (“Personally Identifiable Information”; and collectively with the Non-Personally Identifiable Information, the “Data”). We may also collect and store information, which could include Non-Personally Identifiable Information or Personally Identifiable Information, locally on your computer or device using mechanisms such as browser web storage or application data caches.

For instance, information you provide about yourself in response to questionnaires on our Site may be made available to others such as information concerning your status as an Accredited Investor. As such, other users of our Site may be able to personally identify you based on your information made available on our Site. As a further example, if you utilize Third Party Services to log into our Site, other users to whom you may be connected to through such Third Party Service may be able to view or follow information about you on our Site, including Non-Personally Identifiable Information or Personally Identifiable Information.

Community Crowdfunding employs or contracts with other third parties, companies, or individuals to perform certain functions or services on its behalf. Examples of these services from such third parties, companies, or individuals, may include ID verification, accreditation/financial/credit verification, electronic document signing, payment storing and processing, sending postal mail and e-mail, escrow services, disbursement of funds, analyzing data, providing marketing assistance, and providing customer service. As such, these third parties, companies, or individuals may have access to your information, including Non-Personally Identifiable Information or Personally Identifiable Information, as needed to perform their functions or services, and may not use it for other purposes.

Community Crowdfunding may also use and disclose Personally Identifiable Information and Non-Personally Identifiable Information: to investigate and help prevent potentially unlawful activity or activities that threaten the integrity of our Site or network; to protect and defend our rights or property or the rights or property of others; as required by courts or administrative agencies; and in connection with a financing, sale, merger, or reorganization of Community Crowdfunding’s business or assets. Any successor in interest to our business would acquire the information we maintain, including Personally Identifiable Information, and may alter the terms of this Privacy Policy.

We might sell or buy businesses or assets. We do not endorse, screen, or approve, and are not responsible for the privacy practices or the content of, other websites or services.

MESSAGING

Our Site permits users to communicate with companies and other users posting information on the Site. We may read, collect and analyze information transmitted between users for regulatory compliance and marketing purposes. However, as explained in our Terms of Use, we do not guarantee that information provided by Site visitors or investors is accurate or complete. Community Crowdfunding assumes no liability or responsibility for any errors or omissions in the content of its Site.

EXCLUSIONS

This Privacy Policy does not apply to any Data collected by Community Crowdfunding other than Data collected through the Site. This Privacy Policy shall not apply to any unsolicited information you provide to Community Crowdfunding through the Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as bulletin/message boards (individually and collectively, the “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions (individually and collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Community Crowdfunding shall be free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution.

TESTIMONIALS

We may display personal testimonials of satisfied customers on our Site in addition to other endorsements. With your consent we may post your testimonial along with your name and other information. SOCIAL MEDIA FEATURES

You can log in to our Site using sign-in services such as Facebook, Twitter or LinkedIn. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Services like Facebook give you the option to post information about your activities on this Site to your profile page to share with others within your network. Our Site may also include social media features such as the Facebook “Like” button, Twitter, and similar features. These features are interactive mini-programs and may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

OPT-OUT POLICY

We may at times send you e-mail communications with marketing or promotional materials. Please note that opt-out requests may take up to one (1) week to process. Through your Account settings you will be able to set certain preferences and permissions regarding the visibility of your information, including Non-Personally Identifiable Information or Personally Identifiable Information, to others. You may stop or restrict the placement of Community Crowdfunding’s cookies, Google’s cookies and third party cookies on your computer by adjusting your web browser preferences or a ‘Do Not Track’ setting in your web browser. If you do so, you may still use our Site, but this may interfere with some of its functionality.

We use reasonable efforts to secure access to Personally Identifiable Information in our possession, including bank-level encryption, support instant identification and Account verifications, and may partner with third party providers that provide monitoring to ensure that you have a safe experience on Community Crowdfunding, but will not be liable for any failure to safeguard such information, whether inadvertent or otherwise. Personally Identifiable Information is also stored with third parties who have informed us that they also use reasonable efforts to secure access to Personally Identifiable Information, but we will not be liable for the failure of any third party to safeguard Personally Identifiable Information, whether inadvertent or otherwise.

Wherever appropriate, we obfuscate and/or encrypt information in our systems and/or during information transfer. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

We utilize third party service providers who may store on their servers social security numbers, addresses, financial information, electronic signatures, and payment information. For your security, we only display the last four digits of your bank account information when confirming an investment.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to log off when finished using a shared computer.

CHILDREN’S PRIVACY POLICY

Our Site is not intended for use by children, especially those under age thirteen (13) years of age. No one under age thirteen (13) years of age is allowed to use the Site, provide any personal information or receive our email distributions. We do not knowingly solicit or collect Personally Identifiable Information from children or teenagers under the age of thirteen (13). We reserve the right, in our sole discretion, to change, modify, add, or remove portions of this notice at any time. GOVERNING LAW; VENUE AND JURISDICTION; ARBITRATION

By visiting or using the Site and/or the Services, you hereby:

  • agree that the laws of the State of Illinois, without regard to any principles of conflict of laws that would require or permit the application of the laws of any other jurisdiction, will govern these Terms of Use and all matters related to your use of the Site and the Services;
  • irrevocably agree to submit to personal jurisdiction in Illinois for all purposes; and
  • to the maximum extent permitted by law, irrevocably waive any objection you may now or hereafter have to the laying of venue in the state of Illinois and/or that any claim or action brought in a court of competent jurisdiction in the state of Illinois has been brought in an inconvenient forum; and
  • to the maximum extent permitted by law, irrevocably waive any right you may now or hereafter have to a trial by jury for any matter related to these Terms of Use and/or your use of the Site or the Services.

Unless otherwise elected by Community Crowdfunding (in its sole discretion), any dispute arising out of or relating to the use of the Site and/or Services (including without limitation, these Terms of Use, or any breach thereof), shall be finally resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, or such arbitration body as required by law, rule or regulation, and final judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. The arbitration will be conducted in the English language before a single arbitrator in Illinois. Such arbitration must be commenced within one (1) year after the claim or cause of action arises.

Notwithstanding the foregoing, you acknowledge that Community Crowdfunding hereby reserves the right (in its sole discretion and upon notice to the other party(ies)) to require that any dispute arising out of or relating to the use of the Site and/or Services (including without limitation, these Terms of Use, or any breach thereof) be commenced in any court of competent jurisdiction in Cook County, Illinois, or in the District Court of the United States in the Northern District of Illinois.
